New Jersey's top prosecutor steps down following court rules against her service.
Alina Habba has stepped down as the chief federal prosecutor in the state. This decision was prompted by a legal ruling that questioned her eligibility to hold the office.
Official Departure
US Attorney General, the Attorney General, accepted Habba's resignation on Monday. Bondi stated that the appeals court finding made it impossible for Habba to effectively run her office.
"Do not interpret adherence to the ruling as defeat," she declared. "My fight will now extend throughout America."
Judicial Challenge
The departure was triggered by a federal appellate panel ruled that she had been acting without proper authority as the federal prosecutor. This decision is expected to impact many criminal cases in the state.
The court ruled that a acting appointment that skirted confirmation by the US Senate violated the statute on vacant positions.
Future Role and Reaction
The Attorney General added that Habba will continue working within the justice department as a high-level advisor. They intend to challenge the decision of the ruling, aiming for a reversal.
In a statement, Bondi argued that the judiciary "cannot be permitted to override the President's choice of lawyers responsible for executing the executive branch's core responsibility of criminal prosecution."
Performance in Office
The attorney general highlighted the prosecutor's work and noted that while she was in charge, the Newark saw a one-fifth decrease in crime. It was also reported that the city of Camden had its first summer in 50 years free from homicides.
Connection to Donald Trump
Habba, originally became part of Donald Trump's lawyers in 2021. She later acted for the former president in his business records case in 2024, when he was conviction on 34 counts of financial record manipulation.
Earlier, her appointment to the federal prosecutor position, the former president had stated he was selecting her as his White House advisor in a potential future term, calling the lawyer as a steadfast ally and a relentless legal advocate.
